The Islamic Consultative Assembly has raised objections to the government's bill regarding the method of calculating the adjustment of retirement salaries. These objections, which have been raised by the Board for Reviewing and Aligning Government Bills with Parliamentary Laws, could lead to the nullification of the contested ruling if the bill is not amended within the legal deadline.

Details of the Objections to the Government Bill

This dispute relates to a resolution that considers two different methods for calculating the adjustment of retirement salaries for retirees whose service years partially occurred before the transfer of their service unit. This resolution was approved in the meeting of July 19, 2026, by the Council of Ministers and was proposed by the Ministry of Cooperatives, Labor, and Social Welfare, adding a clause to paragraph 19 of the salary coefficient resolution for the year 2026.

According to the new ruling, the adjustment of retirement salaries subject to paragraph 2 of resolution number 146707/T63480H, for the pre-transfer period, is calculated based on years of service and in accordance with paragraphs 12 and 19 of the salary coefficient resolution, and for the remaining service period, from the time of transfer to the retirement date, it is calculated and applied based on the formula stated in paragraph 3 of the resolution.

Parliament's Opposition to the Segregation in Salary Calculation

The government had set the implementation date of this ruling for the first of Farvardin 1405. However, the Board for Reviewing and Aligning Government Bills with Laws has deemed the legal basis for this segregation in the calculation of adjustments to be contrary to the Seventh Development Plan Law. In a letter from the Speaker of the Parliament to the government, reference is made to clause "R" of Article 28 of the Seventh Development Plan Law.

According to this clause, retirees are divided into two groups: those covered by the Social Security Law and those not covered by this law, and the method of adjusting pensions and salaries for each group is determined in parts one and two of this clause, respectively. The Speaker of the Parliament has stated that the government's resolution is contrary to the law in that it considers a different approach for calculating and implementing the adjustment of salaries for a group of retirees than what is provided for in the law.

These objections not only have legal implications but can also have extensive financial and executive consequences. Therefore, amending this resolution within the legal deadline can help preserve the rights of retirees and prevent the nullification of legal rulings.
