The end of the 23-year occupation of the lands of Fahimi Market in Tehran is the result of years of efforts and legal follow-ups by the municipality of District 5 and the private owner of these lands. These lands consist of 8 plots with a total estimated value of 3 trillion tomans, and continuous follow-ups have facilitated the transfer of official documents and the stabilization of the municipality's ownership.

Details of Fahimi Market Lands

Mohammad Reza Pouryafar, the mayor of District 5, explained that out of the 8 plots, 4 plots with an area of 1,848 square meters and an estimated value of 1,400 billion tomans belong to the municipality. The other 4 plots, with an area of 1,944 square meters, belong to the private owner, whose value is estimated at around 1,500 billion tomans.

He stated that the lands belonging to the private owner had been occupied by others for years, and illegal exploitations were taking place. He noted the continuous efforts of the owner to reclaim his rights. In recent years, the private owner had been determined to assert his rights through numerous legal follow-ups.

Importance of Protecting Ownership Rights

Pouryafar emphasized that the goal of pursuing this case was to free the lands belonging to the private owner and to clarify the legal and registration status of the municipality's properties. This matter reached the execution stage with the coordination of judicial and law enforcement authorities, allowing the owner’s rights to be asserted and the status of the properties to be clarified after years of uncertainty.

The execution of the eviction order and the removal of the occupation from the lands of Fahimi Market was carried out following verbal and written warnings and through the necessary legal procedures, under a judicial order. This action was executed under the directive of the deputy prosecutor and the head of the public and revolutionary prosecutor's office of District 5 in Tehran, in coordination with the judiciary and law enforcement agencies.

Cooperation of Agencies for Executing Judicial Orders

In executing this order, the representative of the prosecutor, the deputy of urban services and environment, the personnel of the Greater Tehran police command, the preventive police, the second district emergency unit, the 140th police station of Bagh Feyz, the municipality protection unit, and the legal manager of the municipality of District 5 were present. This cooperation demonstrates the serious determination of the relevant agencies to assert ownership rights and protect public assets.

The mayor of District 5 stated that the execution of the judicial order and the legal procedures have provided the necessary groundwork for pursuing ownership rights. On one hand, the possibility of asserting the private owner's rights over the freed lands has been established, and on the other hand, the process of transferring official documents and stabilizing the municipality's ownership is also followable.
