Mohammad Baqer Ghalibaf, the Speaker of the Islamic Consultative Assembly, in an official letter to Masoud Pezeshkian, the President, conveyed the opinion of the Board for Reviewing and Aligning Government Resolutions with Laws regarding the amendment to the executive regulations for targeted financial actions against terrorism and terrorism financing. This letter specifically refers to legal incompatibilities in this area and calls for necessary action within the legal deadline.

Legal Incompatibilities and the Need for Reforms

In this letter, Ghalibaf referred to the copy of the Cabinet's resolution number 38190 T 65740 H dated 1405/04/22 and stated that necessary investigations show that this resolution is incompatible with existing laws. According to the text of the letter, the Board for Reviewing and Aligning Government Resolutions with Laws has expressed its opinion on the amendment to the regulations and emphasizes that these amendments will be invalid if not legally corrected.

Ghalibaf further referred to various legal clauses and emphasized that according to the Law on Combating Terrorism Financing ratified in 1394 and also Clause 2 of the Law on the Accession of the Government and the Islamic Consultative Assembly of Iran to the International Treaty on Combating Terrorism Financing ratified in 1397, the identification of terrorist individuals and organizations is the responsibility of the Supreme National Security Council of the country. This point indicates that no entity can independently act in this regard, and the confirmation that the working groups mentioned by the government are included in the amendment resolution contradicts the legal competencies of the aforementioned council.

Legal and Executive Consequences

It is worth mentioning that if this resolution is not amended within the legal deadline, the part of the resolution that has been challenged will become null and void. This issue could have widespread implications for how anti-terrorism actions are conducted in the country and highlights the necessity for close cooperation among the relevant institutions.

It seems that this action by the Parliament is aimed at maintaining legal coherence and preventing potential incompatibilities in the country's executive policies regarding terrorism and its financing. For this reason, further discussions and investigations in this area seem necessary. Ultimately, it is expected that, given the sensitivity of this issue, necessary and timely actions will be taken to prevent legal and executive problems in the future.
